"CCNL ON THE PERSONAL AREA V of the leadership four years 2006-2009 LEGISLATIVE AND FINANCIAL PERIOD 2006-2007 AND 2008-2009 - OPERATIONAL NOTE INPDAP"

As is known, in the Official Gazette No. 180, August 4, 2010, was published on the staff of the Negotiable V for the four legislative biennium 2006-2009 and 2006-2007, while economic, the second two-year financial 2008-2009, was published with the Official Gazette No. 179, August 3, 2010.

These contracts apply to head teachers of the Area V, as defined in art. 2 CCNQ of 1/2/2008, and to the managers of the institutions of the sector AFAM, where present.

INPDAP note with operative paragraph 30/12/2010 59, provided the following clarification.

EMOLUMENTS

Salaries tabular defined in art. Negotiable on the day of the second April 11, 2006 (two-year financial 2004-2005) have increased amounts of the following month gross, for thirteen months, with the following date:

  • from 1 April 2006 of € 15.74
  • restated 1 July 2006 € 26.24
  • restated January 1, 2007 € 141 386
  • from 1 April 2008 of € 15.74
  • restated from 1 July 2008 € 26.24
  • restated January 1, 2009 € 103.30

    a result of these increases, salaries of managers are tabular restated January 1, 2007 and € 41,968.00 on 1 January 2009 € 43,310.90, including both the rate of ^ 13 months. The increases above absorb and include the amounts paid as compensation for contractual holiday.

    The position of the fixed salary, as defined in article. 5, paragraph 1, lett. a) the day of the Negotiable April 11, 2006 (two-year financial 2004-2005) is restated as of 1 January 2007 to € 3,166.68 per year and gross as dal 1° gennaio 2009 la stessa è rideterminata in € 3.556,68 annui lordi, comprensivi del rateo di tredicesima mensilità.

    Nei bienni economici di vigenza dei contratti in esame, il valore massimo della parte variabile della retribuzione di posizione è pari a € 34.195,96 annui lordi.

    Ai fini del trattamento di quiescenza, per tutto il personale destinatario del contratto suddetto, la retribuzione di posizione, sia per la parte fissa che nella sua componente varabile, è utile per il calcolo della quota A di pensione ai sensi dell'art. 13, comma 1. lettera a) del decreto legislativo n. 503/1992 ma non soggetta alla maggiorazione del 18% di cui all'art. 15 della legge 177/1976.

    ECONOMIC EFFECTS OF NEW TREATMENTS

    The increases referred to above have economic effect on the thirteenth full month on the treatment of ordinary retirement, normal and privileged, the allowance of severance pay on termination indemnities, for fair compensation and 'food allowance. These effects also apply to the salary of the position of the fixed and variable enjoyment.

    The economic benefits described above are to be paid at such times and in amounts described herein, however, the staff left the service, with pension rights in the term of the contract. For the purposes of the severance pay, the indemnities, allowance in lieu of notice and that under Article. 2122 of the Civil Code, we consider only the overs completed on the date of termination of service.

    COMPENSATION 'IN LIEU OF REINSTATEMENT

    In lieu of reinstatement in the job of the manager fired unlawfully, art. 21 CCNL the leadership of the V of the July 15, 2010, is expected to pay, by agreement between the parties, an extra bonus, whose amount is determined between two months and a maximum equal to the amount of 24 months.

    To express contractual provision, if the manager has dismissed an age between 46 to 56 years, the compensation could be increased further month (two to seven) in respect of the years concerned. The amounts of monthly payments that also cover the replacement of the pay position already in the enjoyment of the manager at the time of dismissal, to the exclusion of the results.

    For pension purposes the allowance is used to calculate the share of pension B in art. 13 b) of Legislative Decree n.503/1992.

    It should be noted, finally, that for the TFS / TFR are useful:
  • salary table
  • the RIA
  • the salary of the position, the fixed and variable part.
